Accomplishments:
For more than 30 years Mr. Fox has successfully handled cases on behalf of victims of medical malpractice in Michigan and Ohio. Recent examples include:
- A $3.7 million dollar settlement in 2010 for a brain damaged infant who's OB was notified too late of the need to come to the hospital for his laboring patient.
- A $1.1 million dollar settlement in 2009 for an infant suffering injuries as the result of a pediatrician's failure to recognize severe dehydration and hypoglycemia in a breast feeding newborn.
- A $1.165 million dollar verdict in Ohio in 2008 for a man who spent five months in the hospital following the perforation of the small bowel during a laparoscopic hernia repair.
- A $2.5 million dollar settlement in 2008 - a case on behalf of a five year old child who sustained a hypoxic ischemic brain injury as the result of a delay in effectuating delivery. Fetal monitor tracings showed evidence of fetal distress which was not recognized and timely acted upon.
- A $2.375 million dollar settlement in 2007 for a 55 year old man who became paralyzed and cognitively compromised following a stroke. Nursing personnel failed to perform neuro checks as ordered by his physician once admitted to the floor and early signs of intracranial pressure were missed.
- A $3.25 million dollar settlement for a four year old boy who sustained brain damage while undergoing a diagnostic MRI under conscious sedation. Anesthesia personnel failed to closely monitor the child following the administration of Versed and Fentanyl through an I.V.
- A $3 million dollar settlement for a one year old infant who suffered brain damage and cortical blindness as the result of a failure to timely deliver the child by emergency C-section. The labor and delivery were managed by obstetric residents who did not possess the knowledge and skills necessary to recognize fetal distress and the need for emergent delivery.
