Packerland overtime case conditionally certified
On March 25, 2011 Sommers Schwartz and Avanti Law Group filed a lawsuit against JBS Plainwell, Inc, Smithfield Beef Group-Plainwell, Inc., and Packerland-Plainwell, Inc. (collectively Packerland) on behalf of Federico Gomez Lucas, and all other similarly situated hourly production employees of Packerland, seeking overtime wages, liquidated damages, costs and attorney fees. The lawsuit is based upon Plaintiff's claim that Packerland does not pay employees for the time they spend putting on and taking off personal protective equipment and walking to and from their work stations before their shift , after their shift, and at the lunch break. On January 23, 2011 the Court entered an order conditionally certifying the case as a collective action and on January 26, 2011 the court approved Notice to be sent to the potential class members.
