Sommers Schwartz attorney Kevin Stoops filed a class action on behalf of current and former employees of Sneaker Villa who worked as hourly, non-exempt “Key Managers” (store clerks) in the company’s 120 retail outlets across ten states. According to the lawsuit, the defendant maintained a policy of refusing to pay Key Managers overtime premiums as required by the federal Fair Labor Standards Act, despite the fact that the plaintiff and others routinely worked more than 40 hours per week. The suit also claims that the defendant’s management was trained, instructed, and pressured to alter Key Managers’ timecards avoid paying overtime. The lawsuit is pending the U.S. District Court for the Eastern District of Michigan.
