Sommers Schwartz attorney Matthew Turner obtained a confidential $350,000 settlement for the family of a 27-year-old disabled man with multiple severe medical problems, including kidney failure requiring dialysis and a congenital heart condition, whose wrongful death was claimed to be caused by the defendant doctors’ negligence. According to the lawsuit, the patient presented to the emergency room complaining of abdominal pain and difficulty breathing. Despite the patient’s symptoms and complaints, the defendants failed to verify that the patient could maintain safe oxygen levels on room air and maintain his glucose in a safe range, and failed to explain a rising white blood count before improperly discharging the patient from the hospital. The patient had a cardiac arrest at home the next day due to his low blood sugar and low oxygen levels. He was rushed back to the hospital but suffered severe brain injury due to the cardiac arrest. He never regained consciousness and died after a number of months on life support. The medical malpractice lawsuit alleges that had the patient been maintained in the hospital, his blood sugar and oxygen would have been monitored and he would not have arrested and died.
