  • $482,500 Class Action Settlement for Violation of Truck Drivers’ Auto Transport Agreement

Sommers Schwartz attorney Kevin Stoops (along with Megan Bonanni of Pitt, McGehee, Palmer & Rivers) finalized a $482,500 settlement in Macomb County Circuit Court on behalf of a group of truck drivers who entered into contracts with Motor City Auto Transport, Inc. and the company’s owner, James Ferns IV. The class action lawsuit (rarely litigated in state court) alleged that the defendants failed to pay the plaintiffs the agreed-upon 28% per-load rate and, as a result, the plaintiffs received significantly less pay than promised. In addition to damages for breach of contract, the plaintiffs also sought damages for statutory conversion and unjust enrichment in the suit.
