  • $1.9 Million Settlement for Failure to Diagnose and Treat Cerebral Venous Sinus Thrombosis Resulting in Permanent Blindness

Sommers Schwartz attorney Samuel Meklir obtained a $1.9 million medical malpractice settlement on behalf of a woman who suffered permanent blindness due to the defendant’s failure to timely diagnose and treat cerebral venous sinus thrombosis and increased intracranial pressure. During a hospital admission for surgery on her legs, the plaintiff began to experience headaches, neck pain, and blurred vision postoperatively. A series of notations in the patient’s chart shows that three days elapsed between the time she first complained and any specialty consultation was first performed, despite earlier orders for consults. Her complaints went untreated for another six days until urgent MRI and MRA testing was ordered and she was transferred to the hospital’s intensive care unit, and lumbar puncture was later ordered. Due to the defendants’ delay in diagnosing and treating the patient’s complaints, she incurred permanent blindness in one eye, irreversible loss of vision in the other eye, and requires round the clock assistance with daily living needs.
