  • Substantial Settlement for Wrongful Death Caused by Emergency Room Malpractice

Sommers Schwartz attorneys Richard Fox and Richard Groffsky secured a confidential settlement for the estate of a man who died after the Defendant hospital’s emergency room staff failed to properly assess and treat his condition. The decedent presented to the ER showing signs of confusion, mental status changes, and muteness consistent with hyponatremia and low sodium levels. Despite these indications, the ER doctors failed to timely obtain laboratory tests, including a metabolic panel that would have demonstrated the reduced electrolyte levels. The Plaintiff alleged that the Defendants’ delay in diagnosing the condition, which then delayed their reading of the test results and subsequent administration of a saline drip, was a breach of the applicable standard care that resulted in the man’s death.
