  • $4.92 Million Judgment involving Violation of Property Owners’ Constitutional Rights

Sommers Schwartz attorney Andrew Kochanowski received a $3.8 million jury verdict in Bay City, Michigan federal court.  The commercial litigation case centered on allegations that the City of Frankenmuth violated the 14th Amendment of the U.S. Constitution by improperly limiting the use of 37 acres owned by the plaintiffs, who had sought to sell the land to Walmart. Mr. Kochanowski previously secured a $3.6 million verdict in this matter in 2010, but the U.S. Sixth Circuit Court of Appeals overturned the award and remanded the case for a new trial. Another $1.1 million was added for fees and pre-judgment interest, bringing the total award in the second trial to $4.92 million. The case ultimately settled for $3.7 million.
