  • Nursing Malpractice – Failure to Prevent Pressure Ulcers: Drake v. United Home Health Services, Inc.

Sommers Schwartz attorney Matthew Turner filed a lawsuit against a provider of in-home nursing services. According to the complaint, because she was bedridden with impaired mobility, the plaintiff, who suffers from multiple sclerosis, was at greater risk for pressure ulcers. Knowing this, the nurse assigned by the defendant should have regularly examined the plaintiff, properly positioned and repositioned the patient, and taken necessary steps to avoid the occurrence of bed sores. The nurse’s failure to do so resulted in the development of decubitus ulcers on the plaintiff’s sacrum, which ultimately required surgical debridement. Subsequent infection and complications from osteomyelitis necessitated a 7-month stay in a long-term care facility, and the plaintiff later developed an additional ulcer to her right ischium while trying to relieve the pressure in the sacral area. The medical malpractice action is currently pending in Wayne County, Michigan Circuit Court.
