Sommers Schwartz attorney Matthew Turner filed a trucking accident lawsuit on behalf of a man who sustained permanent and catastrophic injuries after an out-of-control truck driver on Interstate 75 struck his vehicle.

According to the personal injury complaint, the plaintiff was traveling northbound on I-75 in his Chevrolet Impala when he was suddenly and without warning struck by the defendant truck driver, who was behind the wheel of a large Kenworth big-rig. The truck driver had lost control of his truck and jackknifed, causing his trailer to wing into the center lane and hit the plaintiff.

The lawsuit alleged that the defendant truck driver exceeded the speed limit, failed to keep a safe and proper lookout, exited his lane of travel before ascertaining whether he could do so safely, and failed to yield the right of way.

Because of the defendant’s negligence, the plaintiff suffered several injuries, including trauma to his brain, spine, shoulder, and knee, and several ongoing psychological and emotional issues. The plaintiff also had to undergo intensive medical treatment, surgery, and therapy, and he cannot engage in his normal occupational, social, and recreational activities. He sought compensation for his medical expenses, past wages, loss of future earning capacity, pain and suffering, and other damages.
