Birth Injury – Failure to Recognize Fetal Distress: Kirkland v. Grady Memorial Hospital

Sommers Schwartz attorney Richard Groffsky filed a medical malpractice action on behalf of Miracle Leavell, who was born at Grady Memorial Hospital, and her mother, Latrassa Kirkland. According to lawsuit, the Defendant doctors failed to properly recognize abnormal fetal heart tracings in Miracle, a danger that should have been addressed with an emergency caesarean section several hours before Miracle’s vaginal birth. Because of this failure, Miracle suffered permanent neurological injury resulting in cerebral palsy, developmental delays, and learning disabilities. This birth injury lawsuit, seeking damages for medical expenses, lost wages, and mental pain and suffering, is now pending in Fulton County, Georgia State Court.
