Invasion of Privacy and Intentional Infliction of Emotional Distress: Jane Doe 1 and Jane Doe 2 v. BHB Investment Holdings II (Goldfish Swim School) and Dr. Oumair Aejaz

Sommers Schwartz attorney Lisa Esser-Weidenfeller filed a lawsuit against BHB Investment Holdings II LLC (operating as Goldfish Swim School) and Dr. Oumair Aejaz, a physician in Oakland County, Michigan, for damages caused by severe privacy violations, negligence, intentional infliction of emotional distress, and violation of the Elliott-Larsen Civil Rights Act for sex discrimination.

Former swim instructors and deck supervisors at Goldfish Swim School, Jane Doe 1 and Jane Doe 2, were secretly recorded while undressed in the community changing rooms at Goldfish Swim School-Rochester from 2020 to 2023. Aejaz, whose children were enrolled at the school, made these recordings without their consent. On August 7, 2024, Aejaz was charged with using hidden cameras to secretly record women and children at both Goldfish Swim School-Rochester and Detroit area hospitals where he worked.

The plaintiffs were vulnerable to Aejaz’s actions due to Goldfish’s employment practices, which required them to change in communal spaces lacking proper privacy. They relied on Goldfish, as their employer and facility owner, to provide a safe environment and protect their bodily integrity, but Goldfish failed in its duty.

As a result, the plaintiffs are seeking compensation for physical and emotional harm caused by Goldfish’s inadequate policies. They also demand that Goldfish take corrective measures to improve its facilities and employment practices to ensure vulnerable individuals are better protected from violations of their privacy and personal dignity.
