Wrongful Death – Hospital Malpractice Causes Fatal Fall in Emergency Room – Hughes v. McLaren Macomb
Sommers Schwartz attorney Andy Dragovic filed a medical malpractice lawsuit on behalf of the family of a 65-year-old woman who died as a result of negligent supervision in the emergency department of McLaren Macomb Hospital.
Family members found Diane Hughes in an altered state of consciousness after taking Ambien. She was transported to McLaren Macomb by ambulance and admitted to the ER. Medical personnel performed tests to rule out internal injuries and categorized Ms. Hughes as a flight, suicide, and fall risk. These designations should have ensured she was always supervised and assisted if she left her bed.
Nonetheless, Ms. Hughes was left unattended in the emergency department while waiting for a bed to become available and was allowed to get out of bed alone multiple times. She fell and suffered significant head trauma, including a subdural hematoma (brain bleed). Over the next few hours, her condition worsened, and she died from her injuries.
Ms. Hughes’s family alleges that the McLaren Macomb staff negligently failed to follow the appropriate standard of care, leading her to suffer a fatal fall. Her family’s lawsuit seeks compensation for her medical expenses, pain and suffering, burial expenses, and their own loss of her society, companionship, services, and income.
