  • Call Center Wage Theft: Shaulis v. AxisPoint Health

Sommers Schwartz attorneys Kevin Stoops and Jason Thompson filed a lawsuit on behalf of “Telehealth Nurses” and “Advice Line Nurses” employed by AxisHealth to receive and respond to patient phone calls. According to the complaint, the defendant required the plaintiffs to undertake necessary job duties such as logging in and out of computer programs and clocking into a timekeeping system, before and after their shifts and during meal breaks. These activities involved up to twenty minutes each day per person, yet the defendant failed to compensate the plaintiffs for this “off the clock” work, much of which was overtime payable at one-and-one-half times their regular hourly wage. The class action is now pending in the U.S. District Court for the District of Colorado.
