On February 27, 2017, Sommers Schwartz attorney Matthew Turner filed a personal injury action on behalf of a woman struck by a falling tree that had been cut down by defendant’s employee, resulting in a severe fracture of her tibia and fibula. On October 12, 2016, the employee was removing the tree in the apartment complex in which the plaintiff resided. According to the complaint, the worker was negligent in failing to properly survey the area for pedestrians, failing to rope off the drop zone around the tree, failing to place adequate warning signs and notices, and failing to appropriately plan and execute the operation in accordance with accepted standards. Additionally, the plaintiff alleged that the worker stood idly by, making no attempt to free her from under the tree or to contact emergency personnel. The premises liability lawsuit is currently pending in Oakland County, Michigan Circuit Court.
