The time in which you must file a lawsuit is dependent upon the type of cause of action that you will be bringing, and what event actually caused your brain injury.
For instance, in the event that your injury occurred from a doctor’s mistake, that would be a medical malpractice action. And the state of Michigan, you would have two years from the date in which the act of malpractice occurred, in which to bring your case. In the event that your brain injury resulted from an automobile accident, you would have three years in which to bring your cause of action. In the event that your brain injury occurred from a defective product, that would be a product liability case. And you would have three years in which to bring your cause of action. So it is dependent upon what caused your injury and the nature of the action in which you bring.
