  • Breach of Teachers’ Employment Contract: Allen et al. v. Human Resource Experts, Inc. et al.

Sommers Schwartz attorneys Daniel Swanson and Tad Roumayah filed suit on behalf of 21 teachers, employed by the defendant, who were assigned to work at the Taylor International Academy charter school. Pursuant to their written contracts, the plaintiffs were 10-month employees, and the defendant was obligated to pay their respective annual salaries over a 12-month period, paid in bi-weekly frequencies over 26 pays. Taylor abruptly closed the school twenty days earlier than its June end date, and students and teachers were locked out of the building. A week later, the defendant informed the plaintiffs that their employment was terminated and that they would only be paid through that date. The breach of employment contract lawsuit alleges that the plaintiffs were entitled to five more salary payments, which the defendant failed and refused to make. The matter is pending in the 52-3 Judicial District Court.
