Michigan Neonatal Injury Lawyers

The initial minutes and days following birth are critical time periods when medical decisions may determine whether a newborn will be healthy or suffer long-term consequences.

Newborns are vulnerable to many conditions and medical issues that can place them at serious risk for permanent disability or death. When the medical team fails to act appropriately and fails to properly identify or treat neonatal problems, the nurse, doctor, or hospital may be held liable for any harm caused to your baby.

The neonatal period can be a critical time, and the attending neonatologist or pediatrician must be vigilant and carefully monitor your baby for warning signs of potential complications. If there is any evidence that the child is in distress, the neonatal team must act promptly to prevent injury or harm.

Medical complications that commonly affect newborn babies include:

  • Breathing problems or respiratory distress that require oxygen or intubation
  • Improper intubation and resuscitation
  • Overventilation from mechanical ventilators or positive pressure ventilation (bagging)
  • Brain dysfunction caused by oxygen deficiency (hypoxic-ischemic encephalopathy)
  • Infections acquired from the mother, most commonly Group B strep or herpes
  • Circulatory problems caused by a repairable heart defect or in a vessel leading to or from the heart
  • Low or abnormal blood sugar
  • Jaundice or high bilirubin levels (kernicterus) due to incompatible blood types during prenatal development
  • Meningitis acquired during the nursery stay

Many instances of negligence and malpractice occur because the hospital or ward is understaffed, thus making it close to impossible to pay proper attention to each and every newborn in the neonatal unit. There also might be circumstances where general pediatricians who are not trained to deal with very sick babies are in charge of the nursery and cannot deliver the necessary care. Additionally, nurses may not have adequate training to recognize the signs and symptoms of an impending problem, thus missing a critical window of opportunity to prevent the newborn from becoming ill or permanently disabled.

Sommers Schwartz attorneys have successfully handled numerous neonatal malpractice claims. We have access to specially trained neonatologists, pediatricians, and neonatal nurses who review all aspects of the medical care that were rendered, and if the proper care and support was not provided, we can identify the mistake and hold accountable those responsible for causing harm to your newborn child.

I will always recommend Mr. Watkins and Sommers Schwartz.

After meeting Mr. Watkins in person and working with him during the proceedings, I realized that the words in his website bio were true. He is a FIGHTER for his clients. No matter what time of day I called, he immediately returned my call. I am glad I made an EXCELLENT decision in selecting him.

I wouldn’t recommend anyone else.

I worked closely with Matt Curtis on a medical malpractice case – he went to bat for me every step of the way. I wouldn’t recommend anyone else.

I was very impressed!

I want to express what a great job Tad did. He made me feel comfortable and important in his role and he was very supportive. I was very impressed.

I couldn’t have asked for better representation and counsel.

Thank you to Tad for representing me on my severance agreement. The entire negotiation was handled efficiently and in an extremely professional manner. I also really appreciated that Tad was transparent about the process and timelines, as well as that he was willing to discuss strategy with me.

I cannot say enough good things about Jason!

I cannot say enough good things about Jason – an incredible lawyer and an even better person. There are very few lawyers that I trust completely, but Jason is one of them and rightfully so.

I was very happy with the service you and the firm provided.

You guys handled yourself in a very professional manner and were true advocates for me during this entire process. I am sure you know better than I, but you guys are not only attorneys but also psychologists. You and your firm will always be in my good graces and I will certainly refer anyone that needs your help.

About Matthew Turner and Tad Roumayah…

As a President and CEO, I have had the opportunity to work with many law firms and attorneys on various legal matters. Recently, I became in need of personal representation in a lawsuit. After a review of alternatives, I received a recommendation for Sommers Schwartz, P.C, and specifically to the…

They are an awesome team and I would recommend them and their firm to anyone.

I contacted Sommers Schwartz to join a class action suit. Kevin Stoops and his assistant Veronica Stewart took my case and walked me through all the documents that I had to sign, explained everything to me, and won my case!
