What is Arbitration?
Arbitration is a type of alternative dispute resolution process that allows parties to privately resolve disputes without going to court. We’re all familiar with it – syndicated court television shows like Judge Judy© and Judge Mathis© are an example of private arbitration where the parties mutually agree to end their disagreement away from the courthouse.
Sometimes, the decision to arbitrate a dispute is built into a contract. When parties sign agreements that contain arbitration clauses, they give up certain legal rights and agree to submit to an impartial third-party for resolution. Typically, an arbitrator’s decision is final and cannot be appealed.
Getting Help with Arbitration
Although intended to secure speedier relief than the court system, arbitration rules are tricky and the process can still be expensive, especially if discovery or expert witnesses are involved. While the case may not go in front of a judge or jury, for all but the simplest of issues, people going to arbitration need experienced counsel.
