Sommers Schwartz attorneys Matt Curtis filed suit alleging the defendants’ failure to properly manage the plaintiff mother’s prenatal care as well as their delay in performing a caesarean delivery, resulting in stillbirth. According to the lawsuit, despite the mother’s repeated complaints of headaches and elevated blood pressure over a two-month period, the defendant obstetrician failed to appreciate the signs of preeclampsia and take exercise the requisite standard of care to diagnose and treat the mother’s condition and ensure the child’s wellbeing. Further, the medical staff at the defendant hospital similarly breached the standard of care owed to the mother and child by failing to properly monitor fetal heart tones and other indicators, which contributed to the C-section delay. The medical malpractice action is pending in Macomb County, Michigan Circuit Court, and plaintiff seeks damages for the alleged birth injury and wrongful death.
