  • Medical Malpractice – Diagnostic Error: Serra v. Beaumont Laboratory, et al.

Sommers Schwartz attorney Matthew Turner filed a medical malpractice lawsuit on behalf of a woman who underwent an unnecessary mastectomy as the result of a cancer misdiagnosis.

Virginia Serra underwent a core needle biopsy of tissue from her right breast on August 11, 2021. The sample was sent to Beaumont Laboratory for pathological examination.

Jining Feng, M.D., Ph.D., analyzed the sample and diagnosed Ms. Serra with invasive ductal carcinoma, a form of breast cancer. Based on this diagnosis, Ms. Serra underwent a partial mastectomy. This surgery included a sentinel node biopsy and 25 minutes of intraoperative radiation treatment.

Subsequently, Ms. Serra learned she did not have invasive ductal carcinoma but usual ductal hyperplasia and papilloma. These are considered normal breast conditions that do not need treatment. If not for Dr. Feng’s negligent misdiagnosis in analyzing Ms. Serra’s biopsy sample, Ms. Serra would not have undergone a mastectomy and additional treatment. In her lawsuit, Ms. Serra seeks compensation for her pain, suffering, humiliation, disfigurement, loss of wages and earning capacity, mental and emotional anguish, anxiety, and other damages and losses.
