  • Orthopedic Malpractice – Improperly Treated Wrist Fracture: Kessler v. Hills and Dales Health Care Corporation, et al.

Sommers Schwartz attorney Matthew Turner filed a surgical malpractice lawsuit for a woman whose broken wrist was negligently treated, resulting in ongoing disability and economic losses.

The complaint alleges that in August 2020, the plaintiff badly broke her right wrist and went to the defendant hospital for medical treatment. The orthopedic surgeon who saw her at the hospital operated on her to repair a displaced radial styloid fracture. 

The wrist did not heal well after the surgery, and the patient underwent two more surgical procedures, the last of which was a wrist fusion. She continues to experience pain and limitations to the full use of her right arm. 

The plaintiff claimed the orthopedist, among other failures, did not correctly stabilize and surgically repair the fracture. If not for these errors, she would likely have recovered fully without the additional operations and could have returned to work. 

She continues to suffer pain, disability, and difficulty using her right arm and hand and has endured extensive physical therapy. The medical malpractice action is pending in Tuscola County, Michigan, Circuit Court and seeks compensation for the plaintiff’s medical expenses, lost wages, diminished earning capacity, disfigurement, scarring, and mental and emotional anguish and anxiety.
