  • Surgical Error – Improperly Performed Laparoscopic Surgery: Stout v. Ascension Providence Rochester Hospital et al.

Sommers Schwartz attorney Robert Sickels filed a surgical malpractice lawsuit on behalf of a 70-year-old man who suffered severe complications after gallbladder surgery. 

According to the complaint, the plaintiff began experiencing abdominal pain in June 2021 and was diagnosed with gallstones, for which he underwent a planned outpatient laparoscopic surgery to treat this condition. Serious complications occurred during and after the procedure, including damage to his bile ducts and a major hepatic artery. Following the surgery, the patient was transferred to Henry Ford Hospital, where he had to undergo a major surgical procedure to repair the damaged bile duct, hepatic artery and re-route his intestinal tract. He then spent many days in the critical care unit with a feeding tube, recovering. 

After discharge, he suffered pain, difficulty eating, and other disruptive and debilitating symptoms. In December 2021, he was hospitalized and diagnosed with a liver abscess related to the August surgery. He continues to suffer pain and impairment in his daily life.

The medical malpractice action alleges that the surgeon was professionally negligent by failing to properly perform laparoscopic surgery and not providing appropriate medical care and treatment.
