  • Surgical Errors – Negligent Repair of Penile Deformity – Elizalde v. Beaumont Hospital

Sommers Schwartz attorney Kenneth Watkins filed a medical malpractice claim on behalf of a minor who underwent surgery to correct a penile deformity.

According to the complaint, the child was born with a Chordee penis (bent penis) and hypospadias (a condition where the urethra is not at the tip of the penis). Consequently, he could not be circumcised until he could be evaluated by a urologist. The defendant urologist assessed the child’s condition, and in performed both a Chordee repair (a glanuloplasty to correct the hypospadias) and a circumcision.

The lawsuit alleges the defendant committed various surgical errors, including putting the penis shaft back together in a crooked manner, inadequately repairing the hypospadias, and removing too much foreskin during the circumcision. As a result, the penis was left misshapen, forcing the child to undergo a second surgery by a different physician. Further, he will have to undergo future procedures for additional repairs. Had the defendant used appropriate surgical techniques, the child would have more likely than not fully recovered with no permanent damage.

The action is pending in Wayne County, Michigan Circuit Court.
