  • Surgical Malpractice – Wrongful Death from Failure to Inform Transplant Recipient of Compromised Donor Liver: Lietz v. Henry Ford Health System, et al.

Sommers Schwartz attorney Matthew Turner filed a medical malpractice action for the estate of a 58-year-old man who died from complications following liver transplant surgery.=

In November 2015, the defendant surgeon performed a liver transplant procedure on the decedent. The lawsuit alleges that before the surgery, the defendant failed to recognize and appreciate that the proposed donor liver was considered marginal for transplant due to 30% macrosteatosis and a significant preservation injury. The suit claims the surgeon violated the standard of care by not fully informing the patient about the characteristics of the donor liver.

The decedent’s condition was not so severe that he urgently needed to accept a marginal liver. His family contends that had the defendant properly advised him about the donor liver, the decedent would have declined the transplant and waited for a more suitable liver with a greater chance of success, which he had done previously. Instead, because of the surgeon’s malpractice, perforations formed in the new liver post-operatively, causing infections, sepsis, and multi-organ failure that resulted in the decedent’s premature and wrongful death.
