Sommers Schwartz attorney Matthew Turner obtained a $275,000 settlement in a matter involving emergency room malpractice. The client sustained a fall and was taken to the hospital where the ER physician diagnosed a right shoulder fracture and dislocation. After six unsuccessful attempts to put her shoulder back in place, her right arm was then extended in the air for approximately an hour before attempting a final unsuccessful reduction effort. The client claimed that the standard of care indicated that no more than two attempts to reduce the shoulder should have been made, and that the ER doctor’s numerous additional attempts caused a brachial plexus injury requiring surgery and extensive rehabilitation.
