On May 1, 2015, Sommers Schwartz attorney Charles Ash secured a $375,000 medical malpractice settlement on behalf of the family of a 17 year-old high school student-athlete who died while seeking treatment from the defendant heart specialist. The boy had been in excellent health and good physical shape, but began to experience shortness of breath. Numerous tests were performed and a critical electrophysiology study was ordered, but was delayed due to the defendant’s failure to recognize the severity of the patient’s abnormalities. One day before the study was to be conducted, the boy’s mother found him unconscious and immediately called EMS. He he was later declared dead with the impression was that he had suffered a cardiac arrest.
