Substantial Settlement Obtained in Surgical Malpractice Case

Sommers Schwartz attorneys Richard Groffsky and Matthew Turner secured a confidential settlement on behalf of their client, a 55-year-old wife and mother of four who suffered serious and permanent injury after undergoing surgery for an arterial occlusion – or blockage – in her upper right arm. According to the medical malpractice lawsuit, the vascular surgeon who operated on the patient performed a thrombectomy, a procedure that the plaintiff claimed was dangerous and below the standard of care for the arterial aneurysm occlusion. Because of the defendant surgeon’s decision to perform the contraindicated procedure, he failed to remove the blood clot that caused the blockage, and allowed it to travel to her carotid artery, preventing blood flow to part of her brain. The patient suffered a stroke that caused permanent neurological and physical deficits, and is now is confined to a wheelchair and requires assistance for all activities of daily living.
