Unpaid “Off the Clock” Work: Poye et al. v. Yelp, Inc.

Sommers Schwartz attorney Kevin Stoops filed a class action on behalf of current and former hourly call center agents employed by Yelp. According to the lawsuit, the plaintiffs worked a full-time schedule and were required to use company computer networks and applications to carry out their jobs. However, Yelp required the agents to perform “off-the-clock” work such as booting-up their computers and software programs before their shifts, working during lunch breaks, and shutting down the computers after their shifts. The agents were not paid for this time, which constitutes a violation of the federal Fair Labor Standards Act. The matter is pending in the U.S. District Court for the Northern District of California.
