  • Unlawful Pay Practices: Hayes et al. v. XPO Last Mile, Inc.

Sommers Schwartz attorney Matthew Turner is litigating a class action on behalf of current and former employees of XPO Last Mile, Inc.such as drivers or installers who assisted in delivery and installation services for XPO. The lawsuit alleges that the plaintiffs routinely worked more than 70 hours per week, but the company failed to pay them overtime at the rate of one-and-one-half times their base rate for hours worked in excess of 40 hours a week. Additionally, the plaintiffs claim that their employer failed to maintain accurate pay records, and retaliated against at least one of the workers for questioning the company’s unlawful compensation practices. The matter is pending in the U.S. District Court for the Western District of Michigan and seeks damages for the defendant’s various alleged violations of the federal Fair Labor Standards Act.
