  • Wrongful Death – Failure to Diagnose Sepsis: Musial v. Oakwood Southshore Medical Center

Sommers Schwartz attorney Matthew Turner filed a wrongful death lawsuit on behalf of the estate of a woman who died after an infection in her spine traveled to her bloodstream, causing sepsis and necessitating cardiothoracic surgery which led to stress on her heart and a stroke. According to the complaint, the decedent’s physicians and hospital emergency room doctors were professionally negligent by failing to recognize signs of an infection, failing to order tests to confirm an infection, and failing to alter her treatment accordingly. The lawsuit alleges that had the defendants acted within accepted standards of medical care, the patient would not have endured pain, suffering, economic loss, and an untimely death. The medical malpractice action is now pending in Wayne County, Michigan Circuit Court.
