Sommers Schwartz attorney Matthew Turner filed a wrongful death action alleging a failure to timely and properly diagnose bladder cancer. According to the lawsuit, the defendant urologist performed a Trans-Urethral Resection of a Bladder Tumor (TURBT) after previously identifying papillary tumors consistent with transitional cell carcinoma. The patient then received a series of Bacillus Calmette-Guerin therapy treatments. Eleven months later, the urologist performed a second TURBT, noting a medium-sized tumor consistent carcinoma. The medical record indicated that there was no pathology report because the specimen was lost. The plaintiff alleges that, despite the notation of the lost specimen, the defendant failed to obtain a subsequent specimen for pathology testing failed to obtain imaging studies of the abdomen and pelvis, failed to properly monitor the patient by regularly performing cystoscopies every three months. The plaintiff claims that the defendants’ medical malpractice ultimately resulted in the patient’s death. The matter is now pending in Huron County, Michigan Circuit Court.
