Sommers Schwartz attorneys Jesse Young and Kevin Stoops, along with counsel from San Francisco law firm Outten & Golden LLP, filed a class action lawsuit on behalf of home-based Telemedicine Specialists and Advice Nurses employed by Kaiser Foundation Hospitals. The plaintiffs claim they were routinely required to perform pre-shift and post-shift “off the clock” work and to travel to mandatory training and staff meetings and to pick up necessary equipment, all without compensation, including overtime pay at one-and-one-half times their regular hourly rate.  Additionally, they claim that the defendant failed to reimburse them for business expenditures incurred in the execution of their duties. The lawsuit, which is currently pending in the U.S. District Court for the Northern District of California, alleges that the defendant’s pay practices violated the Fair Labor Standards Act and California labor laws.
