On March 6, 2024, Sommers Schwartz, P.C., attorneys Jesse Young, Kevin Stoops, and Ethan Goemann filed a collective action on behalf of Gina Boykin, a Michigan employee, and all other similarly situated employees, against U.S. Farathane, LLC, in connection with alleged unpaid overtime wages in violation of the Fair Labor Standards Act.

U.S. Farathane, LLC is a leading source of plastics manufacturing, supplying the automotive industry. The company employs thousands of hourly workers across 14 manufacturing locations in numerous states, including at least 10 Michigan locations.

Boykin and the other employees alleged that U.S. Farathane engaged in a systemic time-rounding scheme, which resulted in unpaid wages for its employees, to the financial benefit of the company. As a result, the employees claimed they were not paid all overtime owed for weeks where they worked more than 40 hours per week, for which they should have been paid 1.5 times the regular rate of pay under the FLSA. U.S. Farathane denied the employees’ allegations and raised numerous affirmative defenses.

The parties engaged in extensive discovery and attended multiple mediations. On January 30, 2026, the parties finalized a settlement for approximately 9,900 hourly employees in the amount of $4.3 million.
