  • Surgical Malpractice – Bladder Perforation: Myers v. Mehta, et al.

Sommers Schwartz attorney Robert Sickels filed a surgical malpractice action on behalf of a patient who suffered a perforated bladder during an appendectomy surgery. According to the lawsuit, the patient presented to the emergency room complaining of abdominal pain and nausea. The defendant surgeon was consulted and examined the patient, who informed the doctor he was involved in a motorcycle accident in the past that caused a pelvic fracture requiring bladder reconstruction. The defendant surgeon diagnosed an “uncomplicated appendicitis,” and scheduled a laparoscopic appendectomy, rather than an open procedure that was indicated because of the patient’s abnormal anatomy. During the laparoscopic surgery, the defendant caused the plaintiff’s bladder to be perforated, which necessitated a second, corrective surgery. The patient continues to suffer pain, incontinence, and other injuries that limit his daily activities, all of which the plaintiff alleges could have been avoided had an open appendectomy procedure been performed. The medical malpractice suit is now pending in Wayne County, Michigan Circuit Court.
