Sommers Schwartz attorneys Jesse Young and Jason Thompson secured a $2.5 million class and collective action settlement against Intertape Polymer Corporation. The case was filed on behalf of Michigan employee, Daniel Evans, and thousands of other hourly employees across the country who alleged that the company violated the Fair Labor Standards Act (FLSA).

Intertape Polymer is a packaging products and systems company that operates 22 manufacturing locations in the United States, including one in Michigan that employs approximately 350 hourly workers.

Evans and the other employees alleged that Intertape Polymer engaged in a systemic time-rounding scheme, which resulted in unpaid wages for its employees for the financial benefit of the company. The employees also alleged that Intertape Polymer failed to include shift differentials and bonuses when calculating their “regular rate of pay” under the FLSA, as well as their corresponding overtime rates. As a result, the employees claimed they were not paid all overtime owed for weeks where they worked more than 40 hours per week, for which they should have been paid 1.5 times the regular rate of pay under the FLSA. Intertape Polymer denied the employees’ allegations and raised numerous affirmative defenses.

On May 5, 2025, the district court gave final approval to a class and collective action settlement and entered a judgment in the amount of $2,500,000. The settlement comprised approximately 1,100 hourly employees who opted into the case under the FLSA and another 3,000 hourly employees who were Rule 23 class members.
