Sommers Schwartz attorney Matthew Turner obtained a confidential $1 million settlement for the family of a 57-year-old man whose wrongful death was caused by a ruptured abdominal aortic aneurysm (AAA). The decedent presented to the emergency room three days before his death with clear evidence of a symptomatic, but not ruptured, AAA, and the plaintiff claimed that the defendant ER physician was negligent in failing to order either a CT scan or ultrasound of the abdomen. The plaintiff claimed that had the patient been taken into surgery for the AAA before it ruptured, he would have had a statistical survival rate of over 90%. Instead, the lawsuit alleged that the defendant misdiagnosed the patient with a viral illness and sent him home, allowing his condition to worsen. When the AAA ruptured a few days later, he was taken to the hospital for surgery but did not recover.
