Sommers Schwartz Files FLSA Claim Against TitleMax Involving Unpaid Overtime
On August 28, 2013, Sommers Schwartz attorney Matt Turner filed a nationwide class action lawsuit against TMX Finance, LLC and TitleMax of Illinois, Inc. on behalf of current and former General Managers in Training (“GMITs”) working at TitleMax locations across the United States.
The GMITs allege that TitleMax violated the federal Fair Labor Standards Act and similar state labor laws by misclassifying them as salaried exempt workers and requiring them to put in excessive overtime hours for which they were never compensated. The GMITs also allege that, in early 2013, TitleMax admitted it violated the law when it reclassified them as hourly non-exempt employees without changing their job duties and without paying them for past overtime worked.
The lawsuit is currently pending in the U.S. District Court for the Northern District of Illinois, and Sommers Schwartz is currently interviewing current and former GMITs from across the country for possible inclusion in the plaintiff class.
