A 39-year-old man was rushed to the emergency room after losing consciousness and experiencing a seizure due to a hypertensive crisis (a sudden, severe increase in blood pressure). Brain imaging showed that he was suffering from Posterior Reversible Encephalopathy Syndrome (PRES). He had elevated troponin not because of a cardiac problem but due to demand ischemia. Contrary to the established standard of care, the Emergency Medicine Physician administered heparin, an anticoagulant. Despite cardiology indicating that heparin was not necessary, no one stopped it. As a result of the hospital’s negligence in starting and failing to stop the heparin, the patient suffered an intracranial hemorrhage and passed away about a month later.
The settlement provides compensation to the estate for the decedent’s expenses, pain, and suffering, and his surviving family members’ expenses, pain, suffering, and loss of his companionship. It also establishes trusts providing his three minor children with college funds, lump sum disbursements, and guaranteed monthly income after they turn 18.
