Sommers Schwartz attorney Matthew Turner secured a $250,000 medical malpractice settlement on behalf a man whose lung cancer went undiagnosed by his radiologist. According to the lawsuit, the man presented to the defendant radiologist for a full body PET scan. The defendant failed to note a mass on the upper right lobe of the patient’s lung and failed to report the mass to the plaintiff’s treating physician. The error in properly interpreting the PET scan delayed the cancer diagnosis for a year, during which time the mass grew and the cancer spread to the lymph nodes. The settlement includes compensation for physical and emotional suffering, loss of income, and the cost of ongoing medical care and treatment that the plaintiff will require for the rest of his life.
