  • Confidential $1.2 Million Settlement for Unpaid Wages and Overtime

Sommers Schwartz attorneys Matthew Turner and Alana Karbal negotiated confidential settlements on behalf of 134 cannabis cultivation and processing workers for unpaid wages and overtime. The workers claimed that their employer failed to properly compensate them in violation of federal and state labor laws.

Sommers Schwartz’s Unpaid Wages and Overtime Litigation Group originally filed a collective and class action lawsuit against the national employer. The complaint alleged that the defendant failed and refused to pay regular and overtime wages in violation of the Fair Labor Standards Act and applicable state laws and breached its employment contracts with its employees.

According to the complaint, workers were required to undergo mandatory health screenings and to put on (“don”) and take off (“doff”) company-issued personal protective equipment (“PPE”) (such as masks, hair nets, arm sleeves, gloves, scrubs, and protective shoes) before clocking into the company’s timekeeping system at the start of their scheduled shifts and when returning from their lunch breaks, and after clocking out of the timekeeping system at the end of their scheduled shifts. The complaint further alleged that the national employer subjected its employees to timekeeping policies and procedures that failed to capture the time its employees spent engaging in the donning and doffing off-the-clock work, and refused to compensate them for the same, which resulted in the employees being deprived of overtime and non-overtime wages. The lawsuit was dismissed in light of arbitration agreements the employees signed with their employer and arbitration demands were subsequently filed in the appropriate arbitration forum.
