The plaintiff underwent a posterior lumbar fusion procedure in May 2015, during which the defendant surgeon placed excessive bone graft material in the neural foramen in at least two spinal levels. Consequently, the particulate matter caused the plaintiff to suffer severe stenosis, lower extremity radiculopathy, and back pain. She was forced to then have a revision surgery to remove the graft material and decompress the nerve roots.

The lawsuit claimed that, had the defendant properly performed the lumbar fusion operation, the plaintiff would not have incurred extensive pain, suffering, prolonged hospitalization, medical expenses, lost wages, reduced earning capacity, and other damages.
