Medical Malpractice – Failure To Diagnose Pompe Disease in Newborn

Sommers Schwartz attorney Rick Groffsky filed a medical malpractice lawsuit alleging failure to properly perform newborn screening and to diagnose Pompe disease. This rare genetic disorder causes progressive muscle weakness and can severely affect the heart and other organs.

The child underwent routine newborn screening the day following his birth. However, an error committed at the lab caused the screening to fail to identify Pompe disease, delaying diagnosis and treatment during the critical early months of the child’s life.

Over the next four months, the child developed serious medical complications, including an enlarged heart, severe muscle weakness, and an inability to swallow. In May 2026, they were hospitalized for two weeks, during which physicians finally diagnosed Pompe disease and began treatment.

Our claim alleges that the department of public health assigned to perform the screening test failed to properly conduct the newborn screening and identify the condition, resulting in a significant delay in providing necessary medical care. The suit seeks compensation for the child’s injuries and anticipated medical expenses, therapies, and attendant care.
