The lawsuit alleged that five years after the plaintiff’s initial hip implant surgery, the device failed, causing him excruciating pain. An x-ray revealed that the femoral neck of the implant was fractured. Over the short amount of time since the procedure, the device became solidly integrated into the plaintiff’s bone, necessitating a complete revisionary surgery that was complicated and not totally effective. He now walks with a limp and can no longer engage in the activities he once enjoyed. The lawsuit further claimed that the manufacturer of the device was aware of its defective design and that its negligence caused the plaintiff’s injuries.
