$3.8 Million Settlement for Unpaid Overtime Wages in Violation of the Fair Labor Standards Act

$3.8 Million

On February 10, 2023, Sommers Schwartz, P.C. attorney Jesse Young filed a collective action on behalf of Delores Featherstone, a Michigan employee, and all other similarly situated employees, against FCA US, LLC in connection with alleged unpaid overtime wages in violation of the Fair Labor Standards Act.

FCA is the eighth-largest automaker in the world based on total annual vehicle sales. Its brands include Abarth, Alfa Romeo, Chrysler, Dodge, Fiat, Fiat Professional, Jeep, Lancia, Maserati and Ram vehicles.  The company employs thousands of hourly workers across manufacturing locations in 17 states, including Michigan locations.

Featherstone and the other employees alleged that FCA failed to properly calculate the “regular rate of pay” and their corresponding overtime rates under the FLSA. As a result, the employees claimed they were not paid all overtime owed for weeks where they worked more than 40 hours per week, for which they should have been paid 1.5 times the regular rate of pay under the FLSA. FCA denied the employees’ allegations and raised numerous affirmative defenses.

The parties engaged in extensive discovery and attended mediation. On August 26, 2026, the Court granted final approval of the settlement in the amount of $3,795,000.
