In November 2012, Sommers Schwartz initiated a lawsuit against Velocity Express, LLC on behalf of a small group of delivery drivers who alleged the company intentionally misclassified them as independent contractors. The matter was filed in the U.S. District Court for the Northern District of California.

On June 3, 2013, the Court granted nationwide conditional certification for all delivery drivers who worked for Velocity. As a result, approximately 3,700 current and former delivery drivers will receive notice of the lawsuit and be given an opportunity to join as members of the plaintiff class.
