  • $6.25 Million Settlement for Permanente Advice Nurses Over Unpaid “Off-the-Clock” Work

Sommers Schwartz attorneys Jason Thompson and Kevin Stoops secured a $6.25 million class action settlement on behalf of Permanente “advice nurses” whose jobs involved answering patients’ health care questions by telephone. According to the lawsuit, the plaintiffs were required to use certain computer programs and applications, and were required to log on to these programs and applications but were not compensated for that time or for time spent logging back on after meal breaks or for the time it took them to log-off of the required systems at the end of their workdays. The plaintiffs sought compensation for the “off-the-clock” work, including unpaid overtime, under the federal Fair Labor Standards Act and California state wage and hour laws.
