Confidential $3,750,000 Settlement in a Medical Malpractice Claim for Birth Injuries

$3.75 Million

Sommers Schwartz attorney Richard Groffsky negotiated a $3,750,000 settlement in a medical malpractice claim for birth injuries.

As a result of a doctor and hospital’s negligence and failure to provide appropriate care to a woman in labor, her child was deprived of oxygen for 85 minutes. The baby developed hypoxic-ischemic encephalopathy (HIE), seizures, and cerebral palsy.

The negligence included improper administration of Pitocin, inadequate fetal monitoring, and failure to recognize and respond to serious complications during labor. Because of this negligence, the child suffered severe, irreversible brain damage that will cause permanent disabilities. The defendants claimed that these injuries resulted from severe maternal infection that preceded and accompanied labor and delivery.

These disabilities will require lifelong medical care and accommodations. The settlement provides compensation to the child for medical expenses, pain and suffering, permanent disabilities, and loss of a normal life and to the parents for medical expenses, pain, suffering, and the loss of a normal parent-child relationship.
