Settlement in Birth Injury Case Alleging Malpractice of Obstetrical Nurses

The lawsuit claims that an NST performed during the day prior to delivery was misinterpreted by reviewing nurses as normal (no physician looked at the study at any time prior to delivery), with the misread test results then communicated to the attending physician. As a result of the nurses’ professional negligence, the child’s condition deteriorated, and the following day the mother presented with clear signs of significant fetal distress. Unfortunately, the opportunity to perform an emergency caesarian section was lost, and the child now has permanent neurological injuries.
